Distance sales contract
This contract is concluded electronically under the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts when you accept an offer in the patient portal. The details of the offer you accept — services, dates, price, what is included and excluded, and its cancellation terms — are an integral part of it.
1. Parties
Service provider: SETTE TECHNOLOGICAL SOLUTIONS YAZILIM SANAYİ VE TİCARET ANONİM ŞİRKETİ ("SetteTech"), a company established in Türkiye.
Registered address: Muradiye Mah. Celal Bayar Üniversitesi Kampüsü Küme Evleri Tekno Kent No: 22, Yunusemre / Manisa, Türkiye.
MERSİS number: 0764090615400001.
Trade registry: Manisa Ticaret Sicili Müdürlüğü, 22818.
E-mail: [email protected].
Customer: the person who accepts the offer with their Klinikbook account, with the details registered in that account.
2. Subject
The subject of this contract is the coordination and organisation by SetteTech of the services described in the offer you accept, and the collection of the payment for them, as set out in the offer.
3. The medical service
The treatment is carried out by the clinic or doctor named in the offer, under the medical relationship between you and that provider. SetteTech is not a healthcare provider and does not give medical advice. The provider may decide, at the pre-consultation or at any time on medical grounds, that a procedure should not be performed; what then happens to amounts paid is set out in the cancellation and refund terms.
4. Formation of the contract
The contract is formed when you confirm the selection of an offer in the portal after reading the pre-information form and this contract. The offer, the payment instructions and the status of your payment remain available in your account.
5. Price and payment
The price is the total written in the offer, in the currency of the offer, taxes included; costs that are not included, such as flights unless the offer says otherwise, are listed in the offer as excluded.
Payment is made by bank transfer, EFT or SWIFT to the account named in the payment instructions, within the stated period and with the stated payment reference. Card details are never requested. If the offer foresees a deposit, the deposit and the balance are paid as written there. A payment not made within its period expires, and the selection may lapse.
6. Performance
Services are performed on the dates in the offer and in the reservation plan you confirm. Passport, visa, flight (unless included), personal travel insurance and fitness to travel are your responsibility.
7. Right of withdrawal
You may withdraw from this contract within 14 days of its formation without giving a reason and without paying a penalty, by notifying [email protected] or using the portal. Amounts paid are refunded within 14 days of the notice reaching us, to the account they came from, without any cost to you.
As the Regulation on Distance Contracts provides, the right of withdrawal does not apply to services whose performance has started with your approval before the withdrawal period ends, or to accommodation and similar services that must be provided on a specific date. In those cases cancellation and refunds follow the cancellation and refund terms and the cancellation terms of your offer.
8. Your obligations
You give complete and accurate health information, follow the provider's medical instructions, attend the pre-consultation and treat the people involved in your care with respect. The consequences of incomplete or inaccurate information are yours.
9. Force majeure
Neither party is responsible for failing to perform because of events beyond its reasonable control, such as natural disasters, epidemics, war, strikes, official restrictions or flight cancellations. The parties then agree a new date or the refund of amounts for services not performed.
10. Personal data
Your personal data is processed as the KVKK information notice, the explicit consent text and the privacy policy describe.
11. Evidence
The electronic records of the platform — your account, the offer, the payment and reservation records and e-mail correspondence — are valid evidence of the contract and its performance.
12. Disputes
Within the monetary limits set each year, you may apply to the consumer arbitration committee, and above them to the consumer court, of your place of residence or of the place where the transaction was made. If you live in the EU/EEA, the mandatory consumer law of your country of residence also protects you.
